Advocate Seller Agreement

Advocate Seller Agreement

Effective date: 7 October 2026
Last updated: 7 October 2026

This Advocate Seller Agreement (“Agreement”) governs the listing of an advocate’s profile and services on the Pak Legal Desk platform (“Platform”). By submitting a profile for listing, the advocate agrees to these terms.

1. Independent Seller Status

The Advocate is an independent seller on the Platform, not an employee, agent, partner, or representative of Pak Legal Desk. Nothing in this Agreement creates an employment, agency, partnership, or advocate-client relationship between Pak Legal Desk and the Advocate, or between Pak Legal Desk and any client of the Advocate.

2. Bar Council Compliance

The Advocate represents and warrants that:

  • They are validly enrolled with a competent Bar Council in Pakistan;
  • Their licence to practise is current and in good standing;
  • They will maintain that enrolment throughout the period of listing;
  • They will notify Pak Legal Desk immediately if their licence is suspended, cancelled, or lapses.

The Advocate agrees to comply with the Pakistan Legal Practitioners and Bar Councils Rules, 1976, including Rule 135 (no solicitation of employment by advertisement) and Rule 136 (no fee-sharing with unlicensed persons). Listing content will be limited to factual information — qualifications, Bar Council enrolment, areas of practice, and contact details. Testimonials, ratings, success rates, and promotional claims are prohibited.

3. No Fee-Sharing

Pak Legal Desk does not take any commission, percentage, or share of the Advocate’s legal fees. The Advocate keeps 100% of the fees agreed with their clients. Pak Legal Desk charges the Advocate only a subscription or platform fee for access to the software. This distinction complies with Rule 136 of the Bar Council Rules.

4. Sole Responsibility for Legal Services

The Advocate is solely responsible for all legal advice, drafting, court appearances, and compliance with professional ethics. Pak Legal Desk is not a party to any engagement between the Advocate and any client, and accepts no responsibility for the Advocate’s professional work.

5. Tax Compliance

The Advocate is responsible for their own income tax compliance, including registration with the Federal Board of Revenue (FBR) and maintenance of Active Taxpayers List (ATL) status. As required by the Finance Act 2025, sellers on online marketplaces must be registered for income tax. Any withholding tax on fees the Advocate receives directly from clients is the Advocate’s responsibility. Where Pak Legal Desk processes any payment to the Advocate through the Platform, applicable withholding may be deducted at source in accordance with law.

6. Indemnity

The Advocate agrees to indemnify and hold Pak Legal Desk harmless from any claim, loss, or expense arising from the Advocate’s professional services, any breach of this Agreement, or any disciplinary action by a Bar Council relating to the Advocate.

7. Suspension and Termination

Pak Legal Desk may suspend or terminate the Advocate’s listing immediately, without prior notice, if the Advocate breaches this Agreement, loses Bar Council standing, engages in professional misconduct, or violates platform policy. Termination is without refund of subscription fees already paid for the current period. The Advocate may appeal within 30 days by emailing [email protected].

8. Governing Law

This Agreement is governed by the laws of the Islamic Republic of Pakistan.
